Chapter 40B: Recent Legal Developments

Chapter 40B is in a state of flux. There have been several important administrative and judicial decisions over the last year. These decisions affect how attorneys advise their clients and how they practice in this very specialized field of law. Practitioners who attend this program will learn about the changes in Chapter 40B and receive a concise, yet comprehensive overview of the recent developments in the Comprehensive Permit arena.

After this seminar, attendees will have a better understanding of the following:

  • Recent decisions from the courts and the Housing Appeals Committee;
  • The status of proposed legislative amendments to Chapter 40B;
  • Recent changes in the Housing Appeals Committee’s administrative procedures and regulations under Chapter 40B;
  • The current state of MassHousing’s administration of project eligibility applications and post-permit implementation of affordability requirements and monitoring;
  • The recent million dollar settlement between a Chapter 40B developer and the Town of Boxborough in a lawsuit filed by the Town to enforce the limited dividend requirement under Chapter 40B.
