Labor Law Basics

The Labor Basics program is designed for attorneys new to labor law who either want to develop a labor practice or advise clients facing a labor issue.

The program will start with an overview of the relevant federal and state statutes. An expert panel will discuss the common issues in labor law and how to address them. At the end of the program attendees will apply what they have learned by working through an analysis of a hypothetical union grievance with the panel.

Some specific topics that will be covered include:

  • relevant federal and state labor statutes/regulations National Labor Relations Act M.G.L chapter 150E and chapter 150A.
  • employer and union “Dos & Don’ts” during union organizing campaigns and/or elections.
  • the meaning of the term “duty to bargain” and the mandatory subjects of bargaining.
  • what an unfair labor practice (“ULP”) is
  • how to draft/interpret collective bargaining agreement grievance procedures
  • how to win/defend grievance arbitrations involving alleged contract violations
  • how to win/defend discipline cases and the 7 steps of “just cause”

The materials for the program will include copies of the relevant statutes, lists of dos and don’ts for employers and unions, examples of collective bargaining agreement grievance procedures and more!
