Separation Agreements: An update

This program will discuss recent case law affecting drafting and judicial interpretation of Separation Agreement Clauses. The panel will explore reasons for and the importance of standard "boilerplate" clauses, as well as why different drafting of specific clauses may help to avoid post divorce litigation. In addition, attendees will gain an understanding of what provisions of traditional opposite sex separation agreements are applicable to same sex divorce agreements and which provisions are not.

Alternative language for the following specific clauses will be discussed:

  • Life Insurance
  • Property Division of Restricted Stock and Stock Options
  • Marital Debt
  • Boilerplate
  • Modification of Alimony
  • Medical and Dental Insurance Coverage
