  • Issues arising in small business Chapter 11 cases following BAPCPA

Consumer Bankruptcy Law: Cases and Issues under BAPCPA

  • Chapter 7 update: Homestead cases under §522 (o), (p) and (q) and real life applications; means test/abuse standard under §707(b); and attorney responsibilities and implications for debtors upon failure to act timely.
  • Chapter 13 update: Adequate protection; refinancing and sales; domestic support issues; tax return responsibilities under §1308; and limitations on chapter 13 debtor’s ability to cramdown secured claims.
