Fixing Broken Life Insurance Trusts

This program is designed to help practitioners identify and address problems that can arise in drafting and administering irrevocable life insurance trusts, including tax issues.

The panel will address failures of Crummey notices or poorly drafted withdrawal provisions, inefficient allocations of GST exemption, and changed circumstances. Attendees will learn techniques for dealing with these problems including transfers to other trusts and judicial modification.

Specific topics include:

  • Crummey withdrawal rules and problems;
  • Generation-skipping tax rules and problems;
  • Tax considerations in transferring life insurance policies out of irrevocable trusts; and
  • Judicial modification of irrevocable trusts.
