Chapter 21E Litigation: Latest Developments

There are constantly new developments and challenges in the practice of law under Chapter 21E, as evidenced by recent trial court and appellate decisions.

This program will explore some of the areas addressed by the courts recently, including:

  • Joint and several liability and other lessons from Commonwealth v.Boston Edison Company, et al.;
  • The effect of Aviall on contribution claims;
  • Insurance coverage for environmental claims; and
  • Successor liability, operator liability and veil-piercing

Attendees will hear directly from the attorneys involved in these cases, as well as other experienced practitioners.

The panel will also provide updates on:

  • Damages and attorneys’ fees;
  • Enforcement trends and priorities; and
  • Litigation involving LSPs.
