This program will provide a “nuts and bolts” overview of the construction process from the perspectives of an experienced developer, lender, lender’s consultant and counsel to a lender. The panel will offer valuable insight into what makes a construction project successful, from the viewpoint of each party.

For the developer:

  • What makes a particular project appealing?
  • What makes the same project viable from a permitting, financing, and economic sense?
  • What are the factors in choosing a design team and a contractor?
  • What are the obstacles during construction to a successful project?

For the lender:

  • What makes a particular project appealing?
  • How does a lender approach a financing decision for a development project?
  • How important is a relationship with the developer, the contractor or both?
  • What are the obstacles during construction to a successful project?

For the lender’s counsel:

  • What are the critical factors in protecting the lender’s interests while keeping the project viable?
  • What is their role in reviewing and negotiating assignments and consents?
  • How do those two roles intersect?

For the lender’s consultant:

  • Who are the clients?
  • What are the goals and how involved is the inspector in the construction process?
  • What is the role in reviewing regular payment applications?
  • What is the role in reviewing changes and claims?
  • How is the reporting done?
  • What are the obstacles during construction to a successful project?
