Real Estate Financing Topics We All Avoid: Insurance, Title Insurance, Bankruptcy, and Mechanic’s Liens Click here to order course materials from this programThursday, May 11, 2006 Sponsor: Real Estate Section This program, designed for attorneys practicing in commercial real estate, will provide insight and guidance on some of the common pitfalls and “traps for the unwary” that lawyers sometimes ignore at their own peril when negotiating and closing real estate loans. The seminar will address insurance, title insurance, bankruptcy and mechanic’s liens, and will provide you with the skills and knowledge needed in order to deal with these hazards effectively. The panel of experienced practitioners will guide you through the intricacies of each financing topic to enable you to effectively protect your clients, whether borrowers or lenders, and yourself. Specific topics will include: Insurance - casualty, liability, builder's risk, rent loss, and terrorism coverages; ACORD forms and evidence of coverage. Title Insurance - the ALTA jacket, endorsements - old and new, including those that apply specifically to loan policies, appurtenant easements. Bankruptcy - preferences, fraudulent conveyances, lease rejection, the automatic stay. Mechanic’s Liens - Section 2 and 4 liens, the partial waiver and subordination of lien form, lien bonds.
