Kelo v. New London : What it means for Massachusetts

Following the recent controversial Supreme Court decision in Kelo vs. New London, which sanctioned the right of the government to take private property by eminent domain for economic development, this program will explore its impact for attorneys practicing in Massachusetts.

The panel will explore the shifting definitions and applications of the “public use” clause as well as how this, and other issues raised in the case, may affect Massachusetts eminent domain condemnation law in general. In addition, attendees will hear in-depth analyses of:

  • U.S. Supreme Court decision in Kelo v. New London
  • Potential changes in eminent domain law into regulatory takings law
  • Potential spillovers from evolving eminent domain law into regulatory takings law
  • Consequences for Massachusetts planning and urban redevelopment
