This seminar offers a rare opportunity to learn about the year’s significant developments in Massachusetts and federal laws that affect your estate planning practice. Topics will include the latest developments in federal tax law, local Massachusetts probate law, the recently enacted Uniform Principal and Income Act and proposed changes in the Homestead Act.

  • Application of Goodridge to estate planning;

Homestead Exemption: Current Law and Pending Legislation

  • Understanding the Massachusetts Homestead Protection and the impact of post-filing recordings, including Mortgages;
  • Impact of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 on Homestead; and
  • Proposed legislation on change to the Massachusetts Homestead Act.

New Legislative Developments – Elective Share:

  • Negotiations on Spousal Share legislation; and
  • UPC version of Spousal Elective Share legislation.
