17th Annual Bankruptcy Bench Meets Bar Conference

Bankruptcy judges and practitioners in the District of Massachusetts will share insights, observations and analysis on key issues for 2007.  This year’s topics will include:

State of the District Opening Presentation
Honorable Henry J. Boroff, Chief Bankruptcy Judge

Hot Topics in Consumer Law
Judge William C. Hillman, Nina Parker and Joseph Collins will discuss the Kibbe decision regarding the means test, serial filing, automatic stay, voluntary conversion, and other "hot" consumer bankruptcy topics.

Recharacterization – From Debt to Equity
Judge Joan N. Feeney and John Morrier will discuss using recharacterization as an alternative to equitable subordination in light of the First Circuit's Merrimac decision.

In pari delicto 
Judge Joel B. Rosenthal and Judy Groves will review the impact of recent First Circuit and Bankruptcy Court decisions on the ability of a trustee or other fiduciary to bring causes of action against professionals, directors and officers.

Plan Confirmation Issues
Judge Robert Somma and Douglas Gooding will cover “reverse cramdowns” utilizing the SPM carveout, practice and procedure and other
confirmation issues.
