Bankruptcy judges and practitioners in the District of Massachusetts will share insights, observations and analysis on key issues for 2007. This year’s topics will include:

State of the District Opening Presentation
Honorable Henry J. Boroff, Chief Bankruptcy Judge

Mortgages: Pitfalls of Business as Usual for Lenders and Their Counsel
As the number of home foreclosures reaches record highs, certain long-standing practices of the mortgage lending industry and their attorneys are coming under increasing scrutiny. Judge Joel B. Rosenthal and Mark C. Rossi will focus on recent case law and statutory developments, the effects of which may profoundly change the way mortgage lenders and their counsel conduct themselves.

Head's I Win, Tails You Lose: Issues Implicated in the "Loan to Own" Strategy in Chapter 11 Post-Radnor
Chief Judge Henry J. Boroff and Lee Harrington will consider the various issues that might arise when a party acquires debt as a mechanism to take over a debtor, including those of debt recharacterization, equitable subordination, the good faith of plan proponents and valuation contests that arise in the current bankruptcy landscape.

Recent Developments Chapter 13 Practice
Judge Joan N. Feeney and Ann Brennan will discuss recent developments in Chapter 13, including the definition of projected disposable income pursuant to Kibbe and Phillips, the treatment of 910 day vehicle claims pursuant to the “hanging paragraph”, and the status of tax return filing and the first meeting of creditors.

The preclusive effect of pre-petition judgments and arbitration awards and
confirmation orders
Judge William C. Hillman and Sanjit S. Korde will address res judicata and collateral estoppel in the bankruptcy context. They will focus on the factors Courts consider in deciding what weight (if any) to give to pre-petition judgments, and will also explore the preclusive effect of Chapter 11 and Chapter 13 Plan Confirmation orders.
