Globalization and the TRIPS Agreement: Realities of Intellectual Property Reforms in India and China

This program will provide attendees with an overview of specific intellectual property protections available pursuant to current regulations in India and China.  Expert panelists will review the regulations in a number of areas including patent, copyright, trademark and trade secrets as well as give an overview of available enforcement mechanisms.  Other topics will include

  • An overview of the TRIPS Agreement
  • The requirements for countries at different levels of development
  • Current Indian and Chinese regulation

Panelists

India:  Pravin Anand, Esq.
Anand and Anand, New Delhi, India

Mr. Pravin Anand, senior partner of ANAND AND ANAND in New Delhi, is a patent and trademark attorney. He has been a counsel in many important intellectual property cases, and he serves on the editorial board of several international intellectual property journals such as IP Asia, Entertainment Law Review and Computer & Telecommunications Law Review.

Pravin Anand has served on several international and national expert groups and committees, including the Patent Law drafting committee for revising and recommending changes to the law. He is the chairman of IPR Promotion Advisory Committee (IPAC) constituted by the Government of India, and the chairman of the IT Committee set up by FICCI, as well as a panelist of the Regional Centre for Arbitration Kuala Lumpur (RCAKL) and WIPO Arbitration and Mediation Center. 

China:  Lester Ross, Esq.
Wilmer Hale Beijing, China  

Lester Ross is a partner in WilmerHale’s Asia Corporate Practice Group.  His practice concentrates on mergers and acquisitions, foreign investment, financial services, project finance, energy and environmental law matters and capital markets.  Mr. Ross has represented foreign companies in the agricultural, automotive, chemicals, energy, environmental, financial, high tech, pharmaceuticals, publishing and service industries in their strategic expansion in China.  He also has extensive experience representing foreign banks and corporations in the United States.  Mr. Ross is former general counsel of the American Chamber of Commerce People's Republic of China and former chair of the Board of Advisors of the International Montessori School of Beijing.

Mr. Ross was recognized in Chambers Asia 2008 for the practice of Corporate/M&A: International Law (China).  He has also been selected as one of Asia's top business lawyers in each edition of AsiaLaw Leading Lawyers since 2004.

Gaytri D. Kachroo, Esq.
Burns and Levinson LLP

Gaytri Kachroo is a partner at Burns and Levinson LLP and head of their India Practice Group.  She practices transactional domestic and international business law, and represents domestic and international small to medium sized companies as outside general counsel, with a particular focus on India, Canada, the U.K., and France. She counsels a number of IT BPO, Biotech, Architectural, Engineering, Direct Marketing, and Collections firms.

Ms. Kachroo also holds LLM and SJD degrees from Harvard Law School focusing on international law and specifically India-US comparative law.  She is currently adjunct faculty at Southern New England Law School and she writes extensively on outsourcing to India, international intellectual property, and international legal issues.

Ms. Kachroo is the co-chair of the International Intellectual Property Law Committee of the Boston Bar Association.
