A significant amount of legal time has been spent analyzing and litigating equal employment law issues in the workplace, such as sexual harassment and race discrimination. Until recently, however, there has been limited focus on an employer’s duties and an employee’s rights under wage and hour laws. This program will educate practitioners on some common issues in the field.

The program will also address "An Act to Clarify the Law Protecting Employee Compensation," signed into law on April 14, 2008. The new law, which will go into effect on July 13, 2008, subjects Massachusetts employers found in violation of the state’s wage and hour laws to mandatory triple damages. Attention will be given to the impact of this new law, as well as its practical application. This seminar is a must attend for attorneys who will be practicing in this new environment.

Specific Topics:

  • Regular Wages
  • Overtime
  • Exemptions/Defenses
  • Collective Action Considerations
  • Treatment of Undocumented Workers
  • Damages
  • Statutes of Limitations
