Today, title insurance is a part of most real estate transactions, from the simplest residential loan closing to a sophisticated commercial redevelopment of an entire neighborhood. Attendees will learn the nature of title insurance, the scope and nature of coverages available to owners and lenders, with a special emphasis on the endorsements available to extend coverage in commercial transactions and how claims matters are handled when a problem affecting the property is uncovered.
Expert panelists will also describe the new forms of title insurance for home owners. The program will also include a discussion of the body of case law which has developed in this area.
Specific Topics will include:
Basics of Title Insurance and Claim Handling
- The nature of title insurance; policy jacket provisions; Schedules A and B
- What the policy covers and what it doesn’t; important cases that define policy coverage
Commercial Underwriting and Negotiation of Coverage
- What coverage is standard/required for buyer/lender; what is needed from seller/borrower to obtain coverage
- Underwriting in a troubled economy; discussion of creditor’s rights; deeds in lieu/foreclosures; mechanic’s and other liens
