This seminar will cover a range of issues, from multiple perspectives, relating to surrogate medical and legal decision making in Massachusetts for patients who lack capacity to make their own decisions.
Specific Topics will include:
- A legal overview of the new Uniform Probate Code, as well as other laws that impact how surrogate decision making authority is granted (as well as clearing up the many misconceptions in this area);
- Presentations on the perspectives and issues facing family members seeking guardianship of loved ones, as well as the perspectives of allegedly incapacitated individuals resisting guardianship;
- A nuts and bolts presentation on the requirements for obtaining guardianship, from the clinical requirements to the legal ones, with commentary from lawyers representing petitioners as well as lawyers representing the allegedly incapacitated individuals; and
- Perspectives of guardians and conservators themselves, including a discussion of the burdens and difficulties of fulfilling such roles.
The various perspectives represented on these panels promises to make this a dynamic and exciting seminar, one that should leave participants with a multi-layered understanding of the law in this fascinating area.
