SJC Amends Rule to Provide Clarity Re: Conduct of Out-of-State Lawyers in MA Last November, the BBA submitted comments to the SJC's Standing Advisory Committee on the Rules of Professional Conduct supporting the adoption of ABA Model Rule 5.5 relating to the unauthorized practice of law and the multijurisdictional practice of law. On November 29, 2006, the SJC amended its Rule 3:07, Rule 5.5, Unauthorized Practice of Law; Multijurisdictional Practice of Law and adopted the language of ABA Model Rule 5.5 verbatim, which now provides guidance in the MA rules about the situations in which lawyers may engage in the practice of law in MA when not admitted in this jurisdiction. Special thanks to the members of the BBA Work Group on Model Rule 5.5. They include: Daniel A. Curto, Chair, of McDermott Will & Emery LLP, Richard L. Neumeier of Morrison Mahoney LLP, Mark C. Fleming of Wilmer Cutler Pickering Hale and Dorr LLP, Peter Gossels of Weston, Patrick, Willard & Redding, P.A., and Edward R. Wiest of Edward R. Wiest, P.C. |
