We will review the recent SJC decision in Giovanella v.
Joseph M. Hamilton
Conservation Commission of Ashland.
In this case the Court held that no compensatory takings of property occurred in the Conservation Commission's denial of a residential lot development under the local wetlands bylaw and buffer zone setback restrictions.  Speakers will include: Joseph M. Hamilton of Mirick, O'Connell, DeMallie & Lougee, LLP who represented the Commission; and Michael Malamut of the New England Legal Foundation, which filed an amicus brief in the case
