BBA APPLAUDS NEW GUIDELINE RE: INSURER PAYEE NOTIFICATION In April 2006, the BBA Council — with a letter to the Client's Security Board of the SJC — enthusiastically endorsed a proposed payee notification rule in Massachusetts requiring insurance companies to notify claimants when the insurance company issued third-party settlement checks to a claimant’s lawyer. The BBA's voice was heard. Last month, the Division of Insurance issued a bulletin instructing insurers to send written notification to consumers when a settlement of $5000 or more is sent to an attorney. The bulletin references the efforts of the BBA and several other organizations to encourage this practice to protect consumers from the small number of lawyers who attempt to steal from their clients. |
