Please join us to hear Mark Stein, EPA Region 1, and John M. Stevens, Jr., Foley Hoag LLP, discuss the implications of the pending Entergy Corp. v. EPA case. The Second Circuit’s decision in Riverkeeper, 475 F.3d 83 (2d Cir. 2007), remanded many aspects of EPA's 2004 rules governing cooling water intake structures at existing steam electric power plants under section 316(b) of the CWA. In Entergy Corp. v. EPA, the Supreme Court will consider whether the CWA permits EPA to employ a cost-benefit analysis in determining the best technology available (BTA) to reduce the environmental impact of cooling water intake structures.

The View from the Federal Trade Commission's Chief
Please join us to welcome Marc Groman, Chief Privacy Officer of the Federal Trade Commission. As the FTC's first CPO, Marc has overseen the creation of policies and procedures to safeguard sensitive data and ensure compliance with federal privacy laws and standards. Since 2004, Marc has served as Counsel to Lydia Parnes, Director of the FTC's Bureau of Consumer Protection, handling matters involving private sector privacy and data security issues. Marc's "two privacy hats" give him a unique perspective, that of a privacy professional who is grappling with practical compliance challenges every day and that of a regulator/enforcer, working on FTC law enforcement actions and policy development. Marc will share his views on some of the key challenges in building an effective, comprehensive privacy program and discuss some of the FTC's recent privacy initiatives.

The Proposed DPH Rules on Pharmaceutical and Medical Device Company Marketing 

Come join us to hear Dianne McCarthy, The Joslin Diabetes Center, and William Mandell, Pierce & Mandell, P.C., speak on the Massachusetts Department of Public Health proposed regulation on Pharmaceutical and Medical Device Manufacturer Conduct. This will be the most comprehensive and stringent state law in the U.S. on pharma and device company marketing activities to health care providers and organizations. Legal counsel for physicians and other prescribing practitioners, teaching and community hospitals, and other health care organizations involved in CME, research and publishing, as well as pharma and device company counsel and compliance officers, need to be conversant on these rules. This Brown Bag Lunch will be an open discussion on the proposed regulation, the public comments submitted to DPH and the possible changes to the final rules.
