Davenport, Deputy Commissioner and Senior Policy Counsel for the Massachusetts Department of Revenue, and Donald Twomey, Tax Counsel, Rulings & Regulations Bureau, Massachusetts Department of Revenue, will be the featured guests at this brown bag lunch meeting. Davenport and Twomey will discuss the Department’s proposed “Entity Classification” regulation which sets out the new statutory rules and the impact of check-the-box conformity on an entity’s status and Massachusetts filing requirements both in the transitional year and future years. Controlling Risk and Liability in the Age of Blogs and Social Networking
In this brown bag lunch, MacDonnell Ulsch, author of "Threat: Managing Risk in a Hostile World" will address how the advent of social networking and related technologies may fundamentally transform the way people communicate and connect on the Internet, and consequently disrupt the traditional methods of assessing legal exposure and risk for Internet-based communications. Some of these technologies are well known, and some are just coming over the horizon. For example, currently available technologies can automatically assimilate myriad blog posts to draw factual conclusions impossible to reach through the examination of any one entry. For companies protecting trade secrets or information with securities laws ramifications, such technology can have profound legal repercussions. Mr. Ulsch will explore these and other areas, to give BBA members insight into this rapidly growing and changing area of the Internet.

It is important for attorneys practicing in the areas of environmental law, real estate transactions and real estate development to understand the practical consequences of Mass DEP’s new policy and enforcement initiatives. Real estate developers, lenders, and investors need to consider vapor intrusion risks in conducting their diligence and negotiating deal terms. Owners of properties that already have been redeveloped, or where development is now underway, face the prospect that additional response actions may be required to address the vapor intrusion pathway. Parties conducting cleanups under the MCP must weigh carefully their options for addressing this pathway in conducting site investigations, risk evaluations, and response actions. This program will explain how the Mass DEP is proceeding with its audits of potential vapor intrusion cases, the implications of MCP requirements and MassDEP guidance on mitigating and preventing vapor intrusion into residential and commercial buildings, and the effect these audits, requirements and guidance have on site cleanup and redevelopment projects.
