Understanding Mandatory Reporting Under the Global Warming Solutions Act

Please join Will Space, MassDEP, and Adam Kahn, Foley Hoag LLP, to understand the Global Warming Solutions Act’s GHG Reporting Requirements. In December 2008, MassDEP promulgated emergency regulations to implement the greenhouse gas emissions reporting requirements of the Global Warming Solutions Act. Since then, MassDEP has been meeting with Stakeholders regarding preparation of more comprehensive regulations. This will be an interesting discussion of what to expect in the comprehensive regulations, including key issues such as what to report, how to verify, and documentation requirements.

Poliner v. Texas Health Systems: The Impact of the Health Care Quality Improvement Act on Physician Peer Review Processes

Join us to welcome Renée M. Landers, Suffolk University Law School, discuss the impact of the health care quality improvement act on physician peer review processes. Last July, the United States Court of Appeals for the Fifth Circuit overturned a $33 million verdict against a hospital system and a department chair for actions taken regarding a cardiologist in peer review proceedings. In Poliner v. Texas Health Systems, 353 F.3d 368 (5th Cir. 2008), the court held that the actions taken to address concerns about Dr. Poliner’s practice pursuant to the hospital’s peer review process were protected by the immunity provided under the Health Care Quality Improvement Act (HCQIA). The court’s commentary on the HCQIA and its impact on the medical peer review process raise concerns for hospitals as well as physicians.

The Proposed Combined Reporting Regulation

Fatale, Chief, Rulings & Regulations Bureau, Massachusetts Department of Revenue, will discuss the new Massachusetts unitary combined taxing structure enacted into law in July, 2008, and, more specifically, the Department’s recently issued Proposed Combined Reporting Regulation. This is a timely event given the Commissioner’s Public Hearing on the proposed regulation scheduled for March 31, 2009. Consumer bankruptcy filings are on the rise and this trend promises to continue. In this program, practitioners will learn about emerging issues in representing both debtors and creditors in the US Bankruptcy Court. Expert panelists are divided into three distinct panels.
Debtors and their attorneys need to know the priority status of tax claims as well as the implications and potential consequences of over withholding and failure to file tax returns. Creditors and their attorneys need to know that there is a right way to seek relief from the stay pursuant to the provisions of § 362, and a wrong way. The wrong way can get counsel and their clients into serious trouble. And since staying out of trouble is always on everyone’s mind, counsel representing debtors and creditors will be able to learn more avoiding potential pitfalls and discuss the often difficult issues they are faced with on a daily basis. The Raids in New Bedford
In March 2007, Immigration and Customs Enforcement agents raided a leather goods factory in New Bedford, Massachusetts, arresting over 350 immigrants charged with working there illegally. We will hear from the attorneys who came to jointly represent the immigrant detainees in Federal Court. They will explain their litigation strategy and describe the effect of the Massachusetts litigation on our country’s immigration policy and practices. Equally important, they will discuss how diverse community and advocacy groups coalesced to mount a forceful defense of the immigrant detainees.

Georgia v. Russia: Enforcing Human Rights in the International Court of Justice

Andrew B. Loewenstein is a partner with Foley Hoag LLP's International Litigation and Arbitration Practice Group and counsel to the Republic of Georgia in its case against Russia before the International Court of Justice for the ethnic cleansing of Georgian civilians in South Ossetia and Abkhazia. He will discuss his experience gathering evidence of ethnic cleansing and Georgia's recent success in obtaining an order from the Court prohibiting Russia from engaging in further discrimination.

New Developments in Massachusetts Health Care Law
This program will discuss a number of new requirements under the state’s Health Care Reform law that went into effect on January 1, 2009. These changes will affect decisions about health benefits made in 2009 by employers, health plans, and employees. Employers may face increased financial liability arising from the changes. Many of these changes were brought about by a recent wave of legislative and regulatory activity related to the law’s Fair Share Contribution (FSC) and Minimum Creditable Coverage (MCC) rules.
