, Harvard Law School, will speak about reforms to improve the treatment of middle class investments, including: improvements of mutual fund taxation; ways to enhance the flexibility and resources of U.S. fund regulators; modifications of the existing ban on asymmetric advisor compensation and the exclusion of foreign funds; and unjustified disparities in the treatment of mutual funds and mutual fund substitutes. When it comes to health care, geography is destiny: elderly residents of East Long Island, for example, are more than twice as likely to die while in a hospital bed (42%) as residents of Denver (20%). In this talk, Jonathan Skinner, Dartmouth College, will first document the extent of geographical variation in health care utilization, drawing on the Dartmouth Atlas of Healthcare and research by John E. Wennberg, Elliott Fisher, and others. He then focus on the implications of these variations.

Given the illiquidity in today’s debt markets, the debt instruments of many companies are trading below their face value, significantly below in many cases. Some companies, and the owners of some companies who are bullish on the companies’ long term prospects, are looking to the purchase of debt at discounted prices as a potentially attractive use of capital. This program will focus on key issues that issuers of debt, and their owners, should consider when considering debt repurchases. The program will also discuss the impact that the tax provisions of the recently passed stimulus legislation will have on these repurchases.

The New Massachusetts Data Breach Protection Law

The State of Massachusetts recently enacted one of the strictest statutory schemes protecting the personal data of Massachusetts residents. The personal data breach regulations, 201 CMR 17, promulgated by the Office of Consumer Affairs and Business Regulation under MGL Chapter 93H, apply to most businesses, including law firms. This program will provide an overview of the regulations and suggest practical protocols for meeting the current January 1, 2010 compliance deadline. The American Recovery and Reinvestment Act of 2009: Understanding and Implementing New Financing Programs in Support of Affordable Housing
Please join Catherine Racer, Massachusetts Department of Housing and Community Development in a brown bag on the American Recovery and Reinvestment Act of 2009. The American Recovery and Reinvestment Act of 2009 (the “Act”), signed by President Obama on February 17, 2009, contains billions of new dollars for affordable housing projects. One provision of the Act allows state housing credit agencies to exchange unused low-income housing tax credits to the U.S. Treasury for cash grants that they can use to provide financial assistance to projects that have been unsuccessful in securing a commitment from a tax credit equity investor. Another provision of the Act provides gap financing for similarly stalled projects through HUD’s HOME Investment Partnerships Program. An attorney from the law firm of Holland & Knight LLP will discuss how the Act provides for these two new funding programs as well as some of the tax implications for projects receiving such funds. Catherine will discuss some of the plans that DHCD is considering for program implementation and identify areas where further guidance from the IRS is needed. *Please note: RSVPs are necessary for security purposes, please remember to bring a form of ID with you.
