Derivatives in Bankruptcy
Speakers from Chatham Financial will join us to give a presentation on derivatives in bankruptcy. Derivatives are an integral part of global financial markets, and are commonly used by both companies and banks to mitigate risk. Whether a company is faced with potential bankruptcy/restructuring or their counterparty bank becomes insolvent, it is important for that company to assemble a team of legal, business, and economic/market practice experts to 1) maximize any hedge asset value (or minimize any hedge liability); 2) optimally restructure and/or replace any ongoing hedges; 3) calculate all valuations using a commercially reasonable process; 4) and adhere to a method that withstands potential attacks of litigation. Join our three distinguished panels as they explore the latest developments in practice issues related to health care fraud. The first panel will survey the newest and the most prevalent areas of fraudulent activity being investigated by the federal and state government. The second panel will provide valuable insights into resolving civil health care fraud cases, including a focus on the challenges that arise in resolving multi-jurisdictional and multi-agency investigations and Qui Tam actions.
