Diverging Claim Structure Strategies for US and International Patent Applications

Jay Sandvos, Bromberg & Sunstein LLP, will join us in the International Intellectual Property Law Committee's next brown bag lunch. In the past, US patents were the main focus of many patent strategies, with international patent protection somewhat of an afterthought. After a US patent application was ready for filing, it would be "Saved as" a PCT application which would be filed as a virtually identical clone of the US application. But that simple approach is no longer viable. Punishing claim fee structures in individual national patent offices impose de facto limits on the numbers of claims that can be filed. In addition, substantive differences in patentable subject matter continue to emerge that need to be addressed and tailored specifically for US and international patent applications. We will explore this subject and its impact on the claim structures in new applications. RSVPs are necessary for security purposes, please remember to bring a form of ID with you. Parties’ expectations of what jurors might do if their case goes to trial shape litigation strategies from the beginning of a dispute. Using two contract cases as examples, the presentation will describe how jurors’ assessment of these cases differed from the parties’ expectations and ways in which attorneys were able to use early intelligence to resolve cases before going to trial. Dr. Davidoff will discuss common variables that influence jurors’ perceptions of fairness and their view of contract disputes. |

The American Recovery and Reinvestment Act, signed into law in February, provides billions of dollars in tax incentives, loan guarantees, and government grants. Federal agencies will soon become responsible for disbursing these funds to innovative clean energy projects. Hattaway Communications will present "Government Clean Energy Funding, including Tax Incentives: What's Available and How to Get It." The session will cover what’s available through the recovery package, including tax incentives and other government funding opportunities. Also discussed will be strategies for positioning companies, large and small, to receive funds, and a review of the process involved in making a company's case to the federal government.
