Access to Justice: Services Mandated and Legal Fees Awarded in Civil Rights Case

and James W. Prendergast, WilmerHale, will discuss their recent victory in the case of Rosie D. v. Patrick, in which plaintiffs successfully prosecuted a class action instituted in 2001 on behalf of Medicaid-eligible children with emotional disturbances seeking home-based services. After nearly eight years of litigation, eligible children are scheduled to begin receiving the mandated services later this year. In January 2009, the Court awarded plaintiffs' counsel over $7 million for legal fees and costs. Moderated by Sara J. Shanahan, Sherin and Lodgen LLP.

The Massachusetts Drug and Medical Device Marketing Code of Conduct and public disclosure system governing marketing by pharmaceutical and medical device manufacturers and distributors to physicians and other health care practitioners will become effective on July 1, 2009. The Massachusetts Department of Public Health has issued its final regulation, 105 CMR 970.000, implementing the new prohibitions, restrictions and compliance program and disclosure requirements mandated under Massachusetts General Laws, Chapter 111N. Our panel will address many of the questions on the scope of the law and the necessary steps for full compliance required by July 1, 2009.

Use of Boston’s Stimulus Funds to Promote Affordable Housing: A Discussion with the Director and Chief of Housing of the Department of Neighborhood Development
Please join us to welcome Evelyn Friedman, The Department of Neighborhood Development for the City of Boston, at this brown bag lunch. Last month, Mayor Thomas Menino announced the availability of Neighborhood Stabilization Program (NSP) funds for the acquisition and rehabilitation of foreclosed and abandoned properties throughout the City of Boston. The funds were made available under the Housing and Economic Recovery Act of 2008 and will be distributed by the City’s Department of Neighborhood Development (DND) for three specific uses: owner-occupied homes, rental properties for low and moderate-income renters, and supportive housing for homeless families. Ms. Evelyn Friedman will discuss the Department’s efforts to help the City recover from the foreclosure crisis and to promote affordable housing throughout the City. This will include a review of the status of the foreclosure issue in Boston today, and a report on the City’s current and planned strategy to stabilize the housing market using existing and new resources provided by the Federal government.

One issue that frequently arises as schools try to balance budgets is how faculty tenure impacts a university's ability to make cuts. This program will discuss how the AAUP and courts interpret tenure rights in the context of university actions to manage their bottom line. Ms. Levinson and Mr. Lapp will discuss and debate the various options, strategies, positions, and outcomes from the faculty and institutional perspective. Parties to a divorce or modification action routinely agree to work with Parent Coordinators during and at the close of litigation in an effort to resolve on-going child related disputes without the necessity of court intervention. As practitioners, lawyers routinely write language into Separation Agreements, Modification Agreements, Paternity Agreements and Temporary Orders that govern the appointment, powers, and functions of Parent Coordinators.   This program will provide an overview of the Parent Coordinator "movement" in Massachusetts and around the country and examine critical issues that are not generally recognized when parties agree to work with Parent Coordinators.
