Current Tax Law Developments in China
Fuli Cao
Fuli Cao, a Jones Day tax partner from Beijing, China, who specializes in international and China tax matters, will provide an overview of the significant recent developments in Chinese tax law. His talk will encompass the new Corporate Income Tax ("CIT"), which will significantly impact multinationals doing business in China, and the Value Added Tax ("VAT") and Business Tax regulations (that came into effect on January 1, 2009). In addition, Mr. Cao will discuss one of the most complex aspects of the CIT, which was introduced in January to provide guidance for transfer pricing (imposing mandatory contemporaneous transfer pricing documentation), advanced pricing arrangements, cost sharing agreements, controlled foreign corporations, thin capitalization, and general anti-tax avoidance. For those doing business in China or working with clients who have business in China, this presentation is not to be missed. Overview of Arbitration as an ADR Alternative
William A. Wise
Panel members, who are both experienced arbitrators and arbitration counsel, will review and comment on the practical advantages and disadvantages of resolving commercial disputes through arbitration. Such advantages may reduce discovery costs, and promote a speedy resolution of the dispute. Disadvantages may include an unacceptable risk of subjecting a 'bet the company' issue to the decision of a single arbitrator. This brown bag offering is ideally suited to the in-house counsel responsible for drafting commercial contracts as well as corporate attorneys with similar responsibilities. Panelists will reference the Rules of Commercial Arbitration of the American Arbitration Association in their respective comments. A handout of those rules will be available to participants. United States Bankruptcy Appellate Panel for the First Circuit ("BAP")
When the United States Bankruptcy Appellate Panel for the First Circuit ("BAP") deconsolidated from the First Circuit a year ago, Bankruptcy Judge James B. Haines, Jr. was appointed chief judge and Mary (Molly) Sharon was appointed as Clerk of the Panel. At this brown bag lunch, the two will provide a brief history of the BAP and an update of what’s new at the BAP including a review of the new rules and practice guides. Did you know, for example, that you may now request a choice of location for oral argument? They would be happy to answer any questions you have about practice before the BAP.
