Environmental Law Section - at BBA; RSVP Greenhouse Gas Emissions and MEPA
Alicia McDevitt, Massachusetts Environmental Policy Act (MEPA) Office, will discuss the development of revised MEPA Office policies regarding Greenhouse Gas (GHG) analysis under MEPA. The MEPA Office has since late 2007 required project proponents to quantify project GHG emissions and identify measures to avoid, minimize or mitigate such emissions, and has developed a protocol to guide project proponents in their analysis and reporting. The MEPA Office is now in the process of revising its policy to build on its experience since 2007 and in light of the many new GHG-related laws passed in 2008. |

PBGC Issues in a Troubled Economy
Israel Goldowitz, Pension Benefit Guaranty Corporation, will join the Boston Bar Association in a program on PBGC issues. PBGC often seeks protections for troubled plans. In addition, PBGC also seeks to prevent unwarranted terminations. Once a plan terminates, PBGC recoveries are generally quite limited, so an ounce of prevention is worth a pound of cure. PBGC risk mitigation efforts include early warning cases, 4062(e) cases, funding liens, and funding waivers, and we seek to maximize recoveries when plans terminate in bankruptcy or outside bankruptcy. |
