PILOT Agreements in the City of Boston and Beyond

, Tax Policy, City of Boston Assessing Department, will speak about PILOT Agreements, including a discussion of the City of Boston's PILOT TAsk Force. He will address the challenges of balancing in-kind services and other community benefits with monetary payments in order to create an equitable system for all tax-exempt property owners. He will also describe possible legislative initiatives explored by the Task Force. This should be a valuable and interesting discussion for representatives of any institution that owns tax-exempt real property, whether or not in the City of Boston, and for municipal officials.

The Supreme Court’s decision in Burlington Northern v. United States

Our panel will analyze and discuss the U.S. Supreme Court’s May 2009 decision in Burlington Northern v. United States, which should be of interest to all Superfund practitioners. The opinion’s two principal holdings address arranger liability and apportionment and will help define the scope and extent of many parties’ liability at Superfund sites. Come hear representatives from EPA and private parties discuss how Burlington Northern may affect both future litigation and negotiations between the government and private parties. Show Me the Money! A Health Care Providers’ Guide to Federal Funding of Electronic Health Records under ARRA ’09
Join Susan Miller, assistant project manager for the NJ-HISPC project and advisor to State Coordinator, NJ eHIT, for an overview of the money for providers with the American Recovery and Reconstruction Act of 2009 (ARRA), both the HITECH funds and the Medicare/Medicaid funds. There are funds that will be disturbed to states by the Office of the National Coordinator and from CMS for Medicare and Medicaid Funding. This funding is for HIE, HIT, and EHR infrastructure. The Governor has nominated the Massachusetts Technology Collaborative to develop a state-wide EHR plan for both the federal funding and the Commonwealth funding. Come hear how it may all fit together.

A wealth of social science suggests that categorizing people is a natural cognitive process and an evolutionary survival skill. Now, a growing body of federal and Massachusetts case law recognize that stereotyping that produces disparate treatment is unlawful. From the USSCT’s seminal Price-Waterhouse decision to the EEOC's family care-giver guidelines to the recent First Circuit decision in Chadwick v. Wellpoint, you will learn the key cases, explore the best practices and perils for employees and employers in litigating the subtle hidden bias case, and pointers for employers on how to avoid such claims.

Reception To Discuss Opportunities To Defend Children's Educational Rights

Please join the BBA Public Interest Leadership Program (PILP) for a reception to introduce the Children's Law Center of Massachusetts, Inc.'s Pro Bono Program which was established to assist children who need legal representation in education matters and whose families cannot afford the high cost of legal services. Come learn about compelling pro bono opportunities to advocate for children's educational rights and ways to develop an expertise in juvenile rights' cases and courtroom skills. A short presentation given by Robyn L. Laukien of the Children’s Law Center of Massachusetts will provide the attendees a general view of the program, and Melissa Nott Davis, McDermott Will & Emery, Bruce R. Kessler, Goodwin Procter LLP, and Elizabeth A. Killingsworth, Goodwin Procter LLP, will share their experiences as volunteer attorneys for the program.

The Origin and Fate of Pharmaceutical and Personal Care Products (PPCPs) In Wastewater:  Environmental Impacts, Treatment Technologies and Water Quality Criteria Development
The environmental role of PPCPs, such as prescription and nonprescription drugs, antibiotics, hormones, and fragrances, is not well understood. Certain PPCPs, known as endocrine disruptors, have the potential to interfere with the normal function of animal endocrine systems and impact growth, development, and reproduction. This panel will explore the susceptibility of surface waters to emerging contaminants and efforts underway to understand and regulate their impacts, including through the development of water quality criteria. Panelists include: Dr. David A. Reckhow, UMass Amherst; Nicholas D. Anastas, Poseidon's Trident LLC; and Ellen Weitzler, Water Quality Standards Branch, U.S. EPA, Region 1.
