Join Kevin W. Brown, General Counsel and Deputy Commissioner of the Massachusetts Department of Revenue, as well as Dr. Susan Windham-Bannister, President and C.E.O. of the Massachusetts Life Sciences Center and Melissa Walsh, Chief Operating Officer of the Massachusetts Life Sciences Center for this informative Brown Bag lunch program. Mr. Brown will discuss the state tax incentives enacted as part of the Governor's Life Sciences Bill, the Department's proposed Life Sciences Technical Information Release as well as the prospective promulgation of regulations related to the Bill. Dr. Windham-Bannister and Ms. Walsh will discuss the mission of the Life Sciences Center as well as the overall review and certification process for Life Sciences companies. Judith K. Crosby, Holland & Knight LLP, will review the Housing and Economic Recovery Act of 2008, which President Bush signed on July 30, 2008. Key provisions of the law include modifications to the low-income housing tax credit program under section 42 of the Internal Revenue Code. This program will summarize the provisions of the act that affect projects financed with low-income housing tax credits and discuss some of the unanswered questions posed by the law. |

Lisa Goodheart, Sugarman, Rogers, Barshak & Cohen, P.C., and Jonathan Sablone, Nixon Peabody LLP, counsel for the parties in Bank, will discuss the case and its implications for practitioners. In Bank, the SJC resolved the long-pondered question whether a party who does not strictly comply with the MCP in performing a cleanup may nonetheless recover its cleanup costs under Chapter 21E. In so doing, the Court also confirmed that attorneys’ fees incurred in the course of implementing the cleanup are recoverable as response costs under Chapter 21E and established a new rule that a party seeking to recover attorneys fees under section 4A of Chapter 21E must affirmatively plead the claim. |
