Ann Berwick, Executive Office of Energy and Environmental Affairs, and Mary Beth Gentleman, Foley Hoag LLP, will discuss the Green Communities Act that Governor Patrick signed on July 2. This is one of the most far-reaching pieces of energy and environmental legislation in the Commonwealth’s history. In addition to legislators and Patrick Administration officials, environmental and industry groups played significant roles in negotiating the terms of the legislation. This lunch program will briefly review the history of the legislation and will focus on how its effects will be felt in the months and years to come. |

The New Form 990 and Final Instructions
Gwen Spencer, PricewaterhouseCoopers, will discuss the final instructions for the redesigned Form 990 (the annual information return filed by tax-exempt organizations, released in 2007) issued by the IRS on August 19, 2008. This substantially revised form must be completed for tax years beginning in 2008. The final instructions contain definitions critical to completing the new form, and provide important context for many of the questions. Ms. Spencer will discuss the instructions and the key issues for 2008 returns. |

BBA CLE: Written Description Guidelines for Patents Revisited: The Page Turns

This spring, the United States Patent and Trademark Office issued new guidelines for examiners on how to apply the written description requirement of 35 U.S.C. 112, first paragraph, to pending patent applications. USPTO official, John LeGuyader, will discuss the reasons for the PTO's implementation of the new guidelines and provide insight into how the guidelines will be applied by patent examiners. |

Wilkins, Anderson & Kreiger, LLP, will analyze the recent SJC decision in Iannacchino v. Ford Motor Co., 451 Mass. 623 (2008),and discuss its implications for practice changes in both administrative and court litigation contexts. The decision abandoned a long-standing Massachusetts standard, which had made it virtually impossible for a respondent or defendant to obtain a favorable ruling on a 12(b)(6) motion. The SJC has now adopted the more lenient federal standard for dismissal of complaints for failure to state a claim. |

Immigration Practice Tips for Non-Immigration Experienced Lawyers
Paul Glickman, Glickman Turley LLP, and Ellen Kief, Law Office of Ellen S. Kief, will review the important issues lawyers from solo and small firm practices face when representing clients in immigration law cases. Immigration consequences of criminal arrests, charges and convictions can have a profound effect upon a non-citizen’s rights and ability to remain in and return to the United States. Small businesses also should pay particular consideration to the immigration status of their employees. Immigration and Customs Enforcement (“ICE”) has the ability to audit employer’s immigration forms (I-9) and fine businesses which are out of compliance and in egregious cases seek Federal criminal charges. The program will also review the various visa options available to non-citizens from visiting the country to seeking permanent status in the United States Immigration is also a consideration in aspects of family law involving marriage and divorce. This program will present the key pointers practioners should be aware of in representing their clients in these areas. |
