The DOJ's Single Firm Conduct Report

, a partner at Ropes & Gray LLP, will discuss the Department of Justice, Antitrust Division's Report entitled “Competition and Monopoly: Single Firm Conduct under Section 2 of the Sherman Act” issued in September 2008. The DOJ's Report has resulted in vigorous debate in the antitrust community about the evolution of the standards for enforcement and liability under Section 2 of the Sherman Act. In addition, the DOJ's Report raises an interesting perspective on the importance of international convergence on such anti-monopoly standards.

Open Brown Bag Lunch – Legislative Initiatives
The Real Estate Legislation and Public Policy Committee will be continuing its discussion of bills previously sponsored by the BBA, including the pending Homestead legislation, a bill concerning the determination of Condominium Common Area Interests, and a bill legitimizing certain non-conforming structures, and to determine which of these may be re-filed in the coming legislative session. Copies of these bills are available in advance by contacting Maria Fernandes at the BBA or either co-chairman of the Committee. We will also discuss potential policy initiatives and coordination with the Governor’s zoning reform task force.

Key Word Advertising Litigation in U.S. & Europe
Keyword advertising is one of the most prevalent forms of advertising on the Internet, with Google, Yahoo and others "selling" keywords that are used to provide advertisement content in response to user searches. When a company "buys" its competitor's trademark so as to display its advertisement in response to a search of the competitor's trademark, not surprisingly, litigation can erupt. John Ward of Novartis Vaccines and Diagnostics will take a look at the current state of litigation taking place in the U.S. and Europe with respect to this controversial issue.

of the Citizens' Housing and Planning Association (CHAPA) will provide an update regarding legislation related to affordable housing that was recently passed or defeated, or is currently pending at the State House. His remarks will be framed in the context of the Commonwealth's current budgetary challenges. At the federal level, Sean will also provide a preview as to any changes in housing policy expected in the upcoming administration of President-Elect Barack Obama and in the new congress.

Update on the Streamlined Wetlands Appeal Program at the one-year anniversary. Margaret R. Stolfa and Salvatore Giorlandino of MassDEP, and Jeffrey Roelofs, Law Offices of Jeffrey Roelofs, will present. The General Counsel and the Chief Presiding Officer of the Office of Appeals at MassDEP will present their views on how the appeal program is working after one year of experience with the program.
