Assisting Tenants Facing Eviction Due to Foreclosure
Esme Caramello
Esme Caramello, Harvard Law School's WilmerHale Legal Services Center, and Zoe Cronin and Ann Jochnick, Greater Boston Legal Services, will discuss how the foreclosure crisis is impacting low income tenants. They will talk about efforts of legal services programs to assist tenants facing evictions when the buildings where they are living have gone into foreclosure, and they will discuss some longer term strategies for tenants that address the crisis.
4:00p BBA CLE: Legal Issues in Same Sex Relationships- at BBA; Register
On November 18, 2008, it will have been five years since the Massachusetts Supreme Judicial Court's landmark decision in Goodridge. Today, the law continues to evolve to deal with the practical aspects of same sex relationships and their legal rights. This seminar will address the legal issues that same sex couples face regarding their children, their marriage, and estate planning. Attendees will learn what couples must do to protect themselves and their families, as well as the consequences of failing to properly plan for marriage, children and death.

Securities Enforcement & Litigation Committee Meeting
The collapse of the auction rate securities market has sparked substantial civil and regulatory litigation. While there have been a number of settlements with brokerage houses, there are still a number of unresolved cases and issues. In fact, recently, the Massachusetts Division of Securities has filed an administrative complaint against Oppenheimer & Co. and several of its officers, alleging fraud in the sale of these investments and seeking rescission of the sales. Speakers will include E. Scott Mayfield of Charles River Associates, Ellen Moynihan of the Securities & Exchange Commission, and Glenn Kaplan, Assistant Attorney General.

CERCLA Lawsuits by Private Parties after U.S. v. Atlantic Research Corp.
In United States v. Atlantic Research Corp. (2007) ("ARC"), the Supreme Court held that a private party who had voluntarily responded to a release of hazardous substances could sue other responsible parties under CERCLA § 107(a) to recover its response costs. Seth Jaffe, Foley Hoag LLP, and Wesley Kelman, United States Environmental Protection Agency, Region 1, will review post-ARC case law and discuss some of the issues left open by the Supreme Court.
