Paul has been a guest speaker at all of the major brokerage houses in Boston and most recently spoke at the SIOR conference in Minneapolis. The TTAB's landmark decision in Medinol Ltd. v. Neuro Vasx Inc. clearly articulated the standard of fraud on the U.S.P.T.O. due to false claims of use in trademark filings. Erica L. Hepp and Emilia F. Cannella, both of Ropes & Gray LLP, will discuss cases that have been decided in a post-Medinol world and the lessons that can be learned for trademark owners and practitioners. They will consider new concerns in trademark filing and prosecution strategy, the potential benefit of using fraud claims as offensive and defensive trademark measures, new approaches for attorneys conducting trademark due diligence review, and ethical considerations for conveying the fraud concept to clients. |

Ring of Chu, Ring & Hazel, LLP provides an overview of game theory, a field of study that uses principles of logic and mathematics to analyze, identify and illustrate the actions that "players" should take in order to secure the best outcomes for themselves in a wide variety of "games." The games in question – ranging from tic-tac-toe to simple and complex card games to thermonuclear war – encompass virtually every form of interaction in which the potential outcomes for each party depend, in whole or in part, on the choices made and strategies adopted by the other(s). This presentation reviews some basic game-theoretic concepts and shows how they can be used by business lawyers and litigators to advance their clients' interests, and by judges and mediators – and lawyers drafting dispute resolution clauses – to manage and resolve legal conflicts. A series of simple demonstrations provides practical guidance on how to use game theory as well as insight into some of its deeper implications, revealing the opportunities that it presents to the legal community and the challenges that it poses to the legal system as a whole. |
