Presentation of Evidence and Monopoly Power in Patent Infringement Suits

Michelle Miller and Mark Ford of WilmerHale LLP will give a presentation on their representation of Braintree Laboratories, Inc. in a recent bench trial before Judge Sue Robinson of the District of Delaware. Braintree Labs., Inc. v. Schwarz Pharma, Inc., Civ. A. No. 03-477-SLR (D. Del.). Braintree was accused of bringing a sham patent infringement suit to block generic entry and maintain its alleged monopoly in a single product market. The case is awaiting judgment. The discussion will cover the presentation of evidence concerning the relevant market, monopoly power, and damages.

Antitrust Year in Review at the FTC
Richard Dagen, Special Counsel to the FTC, will join us for a review of the Federal Trade Commission's antitrust activities in 2007, including:
- The agency's post-merger review of Evanston Hospital 's acquisition of Highland Park Hospital
- Challenges to Equitable Resources
- Western Refining and Whole Foods acquisitions and
- Prosecution of Rambus for monopolization of DRAM technologies.

Mark Botti, Chief of the Litigation I Section of the Department of Justice's Antitrust Division, will discuss current issues playing a role in merger analysis before the Antitrust Division, such as transparency in decision making and the role of direct evidence of effects. He also will comment on the Division's healthcare agenda and its work in the area of competition advocacy.

Mr. Botti has worked in the Department since 1994. His work has included overseeing the Division’s investigation into the Whirlpool/Maytag merger in 2006 and serving as the Division’s principal representative in preparing the Department’s and the FTC’s joint 2004 report, Improving Health Care: A Dose of Competition.

Evan Sue Schouten, Vice President at Charles River Associates International, will discuss CRA's testimony in the longest and most expensive antitrust trial in Australia, Seven Network Limited Anor v. News Limited & Ors.

Seven Network alleged that the defendant cable operator's refusal to carry a sports channel was an unlawful refusal to deal. Ms. Schouten will discuss the analysis of harm to competition of such refusals and will address the differences in market definition under U.S. and Australian competition laws.

Advanced Micro Devices, Inc. v. Intel Corp.
Co-Chairs Gary S. Cooper of Goodwin Procter LLP and Kathryn K. Conde of Nutter McClennen & Fish LLP will discuss the recent decision by the United States District Court for the District of Delaware in Advanced Micro Devices, Inc. v. Intel Corp., C.A. No. 05-441-JJF (D. Del. Sep. 26, 2006). This decision dismissed AMD's antitrust claims based on its foreign commerce as beyond the jurisdiction of the Sherman Act under the Foreign Trade Antitrust Improvements Act of 1982.
We will also be discussing ideas for future brown bag lunch programs.

A Conversation with the Assistant Chief of USDOJ Antitrust Division

John W. McReynolds, Assistant Chief of the U.S. Department of Justice Antitrust Division, will discuss the most common antitrust violations and outline conditions and events that indicate anticompetitive behavior. He will also review enforcements efforts and leniency programs. There will be a question and answer session after the presentation.
