Ann Berwick, Undersecretary for Energy, will discuss Governor Patrick's vision for energy in the Commonwealth, including supplying energy at affordable prices and promoting clean energy. With energy issues at the forefront, Ms. Berwick's insight is timely, and her comments will be informative.
As Undersecretary for Energy, Ms. Berwick has responsibilities related to the Division of Energy Resources (DOER) and to the energy functions of the Department of Public Utilities (DPU, formerly the Department of Telecommunications and Energy DTE), and shares responsibility for integration of energy into the Executive Office of Energy and Environmental Affairs. |

Margery Adams of the Environmental Protection Agency will discuss US v. Johnson, 467 F3d 56 (1st Cir. 2006), which remanded a wetlands enforcement action for further proceedings in light of the Supreme Court decision in Rapanos.
Carol Lee Rawn of the Conservation Law Foundation will discuss Riverkeepers, et al v. EPA, 475 F3d 83 (2d Cir. 2007), which remanded to the EPA aspects of a rule regarding cooling water intake structures of large existing power plants; issues remanded included EPA’s selection of the Best Technology Available for minimizing adverse environmental impacts and its use of cost/benefit analysis. |

I. Changes to Superior Court Standing Order No. 1-88, and to Superior Court Rule 9C
Judges Stephen E. Neel and Ralph D. Gants will discuss the recently promulgated Third Amended Standing Order No. 1-88 and changes to Superior Court Rule 9C. They will also field questions from panelists and the audience on these topics.
II. State of the Superior Court
Chief Justice Barbara J. Rouse will discuss the state of the Superior Court, addressing among other issues, an update on the firm, fair trial date initiative.
III. Expert Panel Discussion About Practicing In the Superior Court
Judges Peter M. Lauriat, Geraldine S. Hines, David A. Lowy, Janet L. Sanders, and Thomas R. Murtagh, will field questions prepared by expert panelists Robert J. Muldoon, Jr., Mary K. Ryan, Joseph D. Steinfield, Richard M. Zielinski as well as questions from the audience.
