1. The Biolab Case and MEPA: Supreme Judicial Court’s Decision in Allen v. BRA

Douglas H. Wilkins of Anderson & Kreiger LLP, counsel for the plaintiffs in the case, and Ronald W. Ruth and David A. Brown of Sherin and Lodgen LLP, who filed an amicus brief in the case on behalf of the Massachusetts Chapter of the National Association of Industrial and Office Properties, will provide their perspectives on the SJC’s opinion in Allen v. BRA and discuss its implications for future MEPA administration and litigation. This case over turned the Secretary of Environmental Affairs certificate on an environmental impact report for the Biolab development in the South End of Boston.

Ken Kimmell, General Counsel of EEOEA, and William L. Lahey, Anderson & Kreiger LLP, will discuss the new tidelands legislation enacted by the House and Senate in November 2007. They also will address MassDEP's proposed changes to the Chapter 91 regulations resulting from recent permit streamlining efforts.

Assistant Attorney General Fred Augenstern, who represented Massachusetts for over eight years in United States v. AEP, will discuss the importance of the consent decree entered by the Federal District Court in Ohio in this case, which was brought by the federal government, Massachusetts and 7 other states against American Electric Power (AEP), one of the largest generators in the United States.  Mr. Augenstern will discuss the scope of emissions reductions under the Settlement, the relationship with the Clean Air Interstate Rule (CAIR), and various mitigation programs.

5. The Future of the Commonwealth’s Division of Administrative Law Appeals

Shelly Taylor, who was recently appointed to the position of Chief Administrative Magistrate of the Division of Administrative Law Appeals, will address the MBA’s Public Law Section to introduce herself, discuss what is on DALA’s current and future agenda, and seek input from members of the bar in establishing both short-term and long-range priorities for the agency.  Both the meeting and its agenda are open and one need not be a member of the MBA to attend.

In addition to a general Q & A session, moving the docket of older cases at DALA, whether and how the bar should participate in evaluating magistrates and overall agency performance, and the impact that feedback from the bar is having at DALA today are all topics on the table for discussion.  If time permits, Magistrate Taylor will also relate the latest on the newest class of DALA cases:  expedited local permit appeals under G.L. c. 43D.

Friday, March 7, 2008 - ALL DAY

A group of Boston area environmental lawyers active in the Environmental Law Section are planning a ski day at Loon Mountain in Lincoln, NH, which will hopefully become an annual tradition.

Tentative plans call for arranging bus transportation, a ski day at Loon and food and drink thereafter at the base of the mountain. Skiers of all abilities and nonskiers are welcome for a day of outdoor fun and fellowship. Non-skiers can participate in tubing, snowshoeing, climbing and cross-country skiing - or even a massage. The planning committee consists of Chris Davis, Ham Hackney, Ralph Child, Carl Dierker, Steve Leonard and Ken Whittaker.


7. ABA Award for Distinguished Achievement in Environmental Law & Policy Call for Nominations

The American Bar Association is seeking nominations for the Distinguished Achievement in Environmental Law & Policy for 2008. The award will be presented at the ABA Annual Meeting in August 2008.
