Steve Clark, of Flynn & Clark, P.C., will conduct a special program to assist foreign lawyers in navigating the temporary and permanent visa process. Specifically, he will explain:

  • the steps for obtaining F-1 Student Visa Optional Practical Training;
  • H-1B Employment or J-1 Training Visas;
  • E or TN Visa;
  • PERM Labor Certification;
  • The I-140 Visa Petition; and
  • I-485 or Consular Processing for Permanent Residence.
He will also discuss:
  • challenges of Bar Admission;
  • the surprising obstacles posed by internships;
  • the use of job experience;
  • the impact of career choices to Specialize in Foreign Law, Foreign Clients, or US Law; and
  • taking a Permanent Job with US firm you have interned or clerked with.

Foreign Lawyer Admission to the Massachusetts Bar

Gregory Osakwe, originally from Nigeria, recently petitioned the SJC in connection with his application to sit for the MA bar exam. The Court found that his common-law legal education and his LLM was sufficient to enable him to sit for the exam.

Mr. Osakwe will discuss his education, legal career, petition and why he chose to file.

Dominance and Harmonization of Regulatory Policy in International Finance

Stavros Gkantinis, SJD candidate at Harvard Law School, will discuss his research Dominance and Harmonization of Regulatory Policy in International Finance.

About his research:

Harmonization o f diverse regulatory regimes in financial services ranks highly on the international political agenda, because regulatory differences raise severe challenges in a world of ever-increasing cross-border financial activity. Conventional theories of harmonization treat U.S. dominance as uniformly strong across various financial markets. Contrary to these approaches, Mr. Gkantinis agrues that harmonization success or failure depends on the interaction of two variables: the degree o f dominance (whether strong competitors to U.S. firms and markets challenge U.S. dominance), as well as activity concentration (whether activity is concentrated at a central facility, such as a stock exchange, or diffused around the world).

Arbitration - Interplay Among Conventions, Laws, Rules & Clauses

William W. ("Rusty") Park, an R. Gordon Butler Scholar in International Law and a Professor of Law at Boston University School of Law, will explore the interplay between the N.Y. Convention, the Federal Arbitration Act, state law, arbitral institution rules, and the arbitration clause in a case where all potentially apply.

The program should be of practical value to both arbitrators and lawyers acting as counsel in arbitrations and arbitration-related litigation.

IDR Committee member Mary Allen Wilkes will chair the program.

Current Antitrust law issues in Mexico

Alejandro Mendiola, Head of the Corporate and Antitrust Practice of the Mexican law firm of Arochi, Marroquin & Lindner, S.C., will address various issues relating to the Mexican Antitrust Law, including recent case law and the current discussion in the Mexican Congress to amend the law. His presentation will also highlight some of the current issues in the M&A arena.

Limitation of Liability in Foreign Jurisdictions

We will discuss the extent to which parties can agree on contractual limitation of liability clauses in agreements in different jurisdictions. We will also examine whether provisions that violate statutory enactments will be held to be void ab initio, or whether courts developed a more flexible approach to statutory illegality by severing the illegal provisions and enforcing the remainder (the so-called “blue pencil rule”).

Our speakers will cover different jurisdictions such as Argentina, England, France, India, Israel, Italy, Japan, the Netherlands, New Zealand, and Switzerland.
