Wondering What To Disclose And How To Do It; Best Practices For Meeting Arbitrator Disclosure Standards

Kurt Dettman, Constructive Dispute Resolutions, and Catherine Shanks, Northeast Manager, American Arbitration Association, will present a summary of a paper proposing Arbitrator disclosure “best practices”. This paper, prepared by the Arbitration Committee of the American Bar Association Dispute Resolution Section, will provide guidance for an Arbitrator to avoid his or her award being attacked for an alleged failure to disclose and is in the process of being circulated to the national and international ADR Community for comment.

Co-mediation is the standard in family law, but is it effective in multi-party commercial disputes? What are its advantages and pitfalls? Arbitration - Interplay Among Conventions, Laws, Rules & Clauses

William W. ("Rusty") Park, an R. Gordon Butler Scholar in International Law and a Professor of Law at Boston University School of Law, will explore the interplay between the N.Y. Convention, the Federal Arbitration Act, state law, arbitral institution rules, and the arbitration clause in a case where all potentially apply.

The program should be of practical value to both arbitrators and lawyers acting as counsel in arbitrations and arbitration-related litigation.

IDR Committee member Mary Allen Wilkes will chair the program.

Mediating Complex Commercial Disputes

James E. McGuire, of JAMS, and Jeffrey S. Stern, a senior partner at Sugarman, Rogers, Barshak & Cohen, P.C. and Chair of the firm’s ADR practice group, will speak about mediating complex commercial disputes.

After many years representing parties in complex litigation, Mr. McGuire now serves as a mediator of these disputes.  Mr. Stern still represents parties in complex litigation and also serves as a mediator.  With experience as both advocate and neutral, they will offer insight into what makes a commercial dispute complex and how that complexity impacts mediation.

The program promises to be informative for both litigators and mediators.

Commerical Arbitration: Why and How


Panelists will discuss the pros and cons of arbitration from a transactional lawyer's perspective, the various questions that arise in drafting an arbitration clause, and common issues arising in the conduct of arbitrations and the enforcement of awards. Special emphasis will be placed on the law applicable to domestic or international arbitrations taking place in Massachusetts. The presentations and discussion will be of value for both in-house and outside lawyers whose practice includes commercial transactions and disputes.
