Actionable Injury in Consumer Class Actions in the Wake of Aspinall and Hershenow

Join Beth I.Z. Boland of Bingham McCutchen LLP and Andrew A. Rainer of the Massachusetts Attorney General's Office will discuss the developing case law on what injury must be pled to state a consumer claim under chapter 93A following the Supreme Judicial Court's decisions in Aspinall v Philip Morris Companies and Hershenow v. Enterprise Rent-A-Car Company of Boston. Our well-experienced presenters will lead a discussion of recent decisions, including the Massachusetts Court of Appeals' February 2008 opinion in Kwaak v. Pfizer, Inc., and will address the numerous significant cases now on appeal. This is certain to be a valuable exchange on where we now stand and where we are headed in the continually developing c. 93A landscape.
