1. Recap: Negotiations Workshop: Price Negotiations

We had great attendance for this highly practical seminar! Ron Scharf, associate general counsel at ITA Software, joined by David Lax of LaxSebenius, covered fundamental concepts in price negotiations and taught us how to do better for our clients.  This was the first in a multi-part program series that forms the basis for the Harvard Business School Executive program called Strategic Negotiation.  Subsequent classes will include Negotiations in Long-Term Relationships, Creating & Claiming Value and Multi-Party Negotiations.   Dates to be announced, so stay tuned!

3. BBA CLE: The Intersection of Family Law and Trusts: What every practitioner should know

More and more, married couples are making use of different types of trusts to handle complex issues.  Maintaining life insurance, planning for a child’s education and caring for someone with special needs are just some of the instances where a trust can help manage these financial concerns.  When a couple divorces, the maintenance of such trusts can become even more complex.  It is important for practitioners to understand the function and administration of these trusts and to know how to identify some of the common issues that present themselves in a divorce.

This program will discuss how life insurance, educational and special needs trusts are impacted by divorce.  Requests for alimony and child support can create a host of complicated tax and estate administration issues. The panel for this program, which includes a judge and two experienced practitioners in estate planning and family law, will provide an overview on and address some of the key points surrounding the various types of special trusts.

4. BBA CLE: Computer Software Licensing 101

Your client’s proprietary software is a valuable business asset.  The terms and conditions on which this software is licensed are key to protecting this asset.  Understanding the basic elements of a software license is the first step to helping your clients create a software license agreement that best meets their needs.   Negotiating tactics from the licensor’s and licensee’s perspective will be discussed.

Once avoided, open source software is routinely used by engineering organizations to speed time to market and reduce costs.  Clients are looking to better manage their use of open source software, ensure compliance with open source licenses, and protect their rights in proprietary software which may link to or have open source embedded therein.  You will learn how to spot and address open source software issues and why these issues may be important to your clients.

6. BBA CLE: Labor Law Basics

This program is designed for attorneys new to labor law, who wish to develop a labor practice or advise clients facing labor issues. 

The panel of experienced practitioners will provide an overview of the relevant federal and state statutes and will culminate with audience participation in the analysis of a hypothetical union grievance, challenging an employer’s decision to discipline an employee. 

Other topics that will be discussed include:

  • employer and union “Do’s & Don’ts” during union organizing campaigns and/or elections
  • explanation of “duty to bargain” and the mandatory subjects of bargaining
  • what an unfair labor practice (“ULP”) is
  • collective bargaining agreement grievance procedures.
