1. BBA CLE: Labor Law Basics

Thursday, December 13, 2007
4:00 p.m. – 7:00 p.m.
Boston Bar Association

This program is designed for attorneys new to labor law, who wish to develop a labor practice or advise clients facing labor issues. 

The panel of experienced practitioners will provide an overview of the relevant federal and state statutes and will culminate with audience participation in the analysis of a hypothetical union grievance, challenging an employer’s decision to discipline an employee. 

Other topics that will be discussed include:

  • employer and union “Do’s & Don’ts” during union organizing campaigns and/or elections
  • explanation of “duty to bargain” and the mandatory subjects of bargaining
  • what an unfair labor practice (“ULP”) is
  • collective bargaining agreement grievance procedures.

Ron Scharf, associate general counsel at ITA Software, joined by David Lax of LaxSebenius, will explore issues of relationships, communication, trust and ethics in negotiations.  By participating in a short but revealing exercise, the class will explore such topics as:

  • How should I balance my competitive and cooperative urges.
  • How can I influence my counterpart to be more cooperative than competitive?
  • How do I gain my counterpart’s trust in a negotiation?
  • How do I decide whether to trust the other side?
  • Can I be trusted?
  • How much do my actions today affect my options in the future?
  • How do I weigh ethics against my short and long-term best interests?

This is Part II of the Negotiations Series being offered as a free program series exclusively to BBA members! The courses are desigend to be taken independently or in conjunction with one another.
