Computer Search and Seizure: Current Issues

Our program, led by Adam Bookbinder, US Attorney’s Office, Seth Berman, Stroz Friedberg, LLC, Allison Burroughs, Nutter McClennen & Fish LLP, and Dana Babbin, The Middlesex District Attorney's Office, will be a discussion focusing on two recent cases and the complex issues they raise concerning the legal limits of searching and seizing computers.

In the first case, Commonwealth v. McDermott, the SJC held that a warrant that authorized a search for records also supported the seizure and later search of a computer capable of storing the information specified in the warrant, even though the police had had no independent probable cause to search the computer or even knowledge that the suspect had a computer. The case also discusses whether a search warrant application has to detail the search techniques that will be used to determine what evidence is on a computer.

In the second case, U.S. v. Arnold, the 9th Circuit held that a customs search at the airport was the equivalent of a search at the border, where a warrantless search of any container, especially one that was readily mobile, was permitted. The court reversed an order granting a motion to suppress evidence seized from the defendants laptop, holding that reasonable suspicion is not required by customs officers prior to searching a computer according to the border-search doctrine. This case also discusses whether it is particularly offensive or onerous to conduct a search of personal computer drives in the context of a border search.

Both of these cases raise significant issues concerning whether and under what circumstances law enforcement can access information stored on a computer and how they can ensure that the information found on the computer will be available for use at a later trial or other legal proceeding.

Shut Out by the H-1B Cap: Staying and Working in the US

Last year 240,000 graduating foreign students and experienced specialty workers were told they could not work or remain in the US simply because Congress had failed to update the 65,000 H-1B visa allocation that was sent decades earlier, despite broad support for a more realistic number from industry and academia.

This presentation will discuss the work and training visa options available for these applicants including the new rules announced April 8 to allow STEM majors (Science, Technology, Engineering and Math) to extend their post-graduate practical training from 12 to 29 months, and all students to remain in the US for at least one shot at an H-1B visa.

We will also explain the alternatives: qualifying for an exemption from the H-1B cap; parking the workers abroad with a B visitor's visa, then bringing them back as an L intercompany transfer after a year; Training Hs and Js; E treaty investors and traders; Extraordinary Ability O's; or a quick EB2 PERM labor certification if worldwide immigrant visa options hold out.

The Boston Area Universities Election Improvement Project is attempting to implement real-world programs that improve the electoral process and increase understanding of voting behavior.

The Project has two primary facets, the first focusing on vote administration and the voter experience, the second focusing on program evaluation and statistical techniques. Beyond this information being of interest on its own, it will also facilitate the study of quantitative methods used to understand voting behavior, such as might be used in voting rights analysis. These new methods would be designed to replace current techniques used in, among other places, federal courts.

Join us as a distinguished panel discusses the latest discovery issues in District and Superior Court. Specific cases include:
- Commonwealth v. Adjutant: The Court may introduce evidence of victim's prior violent conduct in self-defense cases. Panelists will discuss the decision and its rationale, how the obligations of the prosecutor/defendant have changed because of this ruling, unresolved issues and how the case is playing out in court.
- Commonwealth v. Dwyer: This case provided the "New Standard" for requests of privileged or likely to be privileged records of victims and witnesses in all types of cases. Panelists will discuss prosecutors' responsibilities, new procedural protections for victims and witnesses, responsibilities of Defense and the experience of practitioners.
- Commonwealth v. Durham: A judge may order a defendant to provide the prosecution with written statements of witnesses whom the Commonwealth intends to call at trial. Panelists will discuss the Reciprocal Discovery Obligations and limitations of the ruling, its application of the case to new Rule 14 discovery requests and the experience of practitioners.

Lauren Stiller Rikleen: Lauren is a senior partner in the Real Estate and Environmental Law Group of Bowditch & Dewey and the Executive Director of the Bowditch Institute for Women’s Success. She has a diverse environmental law practice emphasizing negotiation, enforcement and compliance issues. She is also an experienced mediator. Lauren is the author of Ending the Gauntlet: Removing Barriers to Women’s Success in the Law, a book about the institutional impediments to the retention and advancement of women in the legal profession. Lauren is a past President of the Boston Bar Association.

Marguerite Fletcher Ingram: Marguerite is a Senior Consultant at Vernā Myers Consulting Group, a group that works with law firms to face the challenges of diversity and inclusion. Ms. Fletcher Ingram also has a solo law practice, in Newton, Massachusetts, which is focused on corporate and intellectual property law. Her primary clients are in the software, telecom and biotechnology areas. She has practiced law for over 16 years in corporate, international and intellectual property areas. Marguerite has practiced law as an associate at Hale and Dorr (now known as Wilmer Hale), and as a member of two corporate law departments, Lotus Development Corporation/IBM and Genuity, Inc.

Kathy Weinman: Kathy is a partner at Dwyer & Collora, LLP focusing on white collar criminal and other government enforcement investigations, prosecutions, and appeals. She defends individuals and corporations in numerous federal and state matters, including health care fraud, bank fraud, securities law violations, and government contracting fraud. Kathy has been a litigator for over 20 years. She began her law practice with Wilmer, Cutler & Pickering (now WilmerHale) in Washington, D.C. In addition to her role as a founding partner of Dwyer & Collora, Ms. Weinman is an active leader of the Boston Bar Association where she now serves as President-Elect and member of the Executive Committee and previously chaired the Criminal Law Section and the Membership and Nominating Committees.

Paula Andrews: Paula is a partner at Hinckley, Allen & Snyder LLP and a member of the firm's Financial Transactions Practice Group. She has extensive experience in representing commercial borrowers and institutional senior and junior lenders in complex credit facilities for middle market companies. Her expertise includes all aspects of revolving credit and term loan secured and unsecured credit facilities, including syndicated secured domestic and international financings with cross-border structural and collateral issues, asset-based and cash flow financings and letters of credit. Paula is a trustee of the Boston Bar Foundation.

Negotiations Workshop: Step by Step - Session I: Price Negotiations
Ron Scharf, associate general counsel at ITA Software, joined by David Lax of LaxSebenius, will cover fundamental negotiation concepts and apply the principles during simulation exercises in a multi-part program series. These courses are the basis for the Harvard Business School Executive program called Strategic Negotiation, and are being offered as a free program series exclusively to BBA members! The courses are desigend to be taken independently or in conjunction with one another.

The first class will be a discussion of price negotiations. Questions to be answered include:
- Who should make the first offer?
- If I make the first offer, what should it be?
- How do I handle subsequent concessions?
- How can I shape the other sides perception of the negotiation to my advantage?
- What are some key tools that I can use to persuade the other side to accept my desired proposal?
- How do I handle extreme offers?

Happy Halloween! Join us for an spooky evening on the Ghosts & Gravestone trolley, where we will hear local tales and legends while taking a trip through Boston's historic burial grounds.
