The CM At Risk Approach As Used At The Recently Completed Worcester Trial Court Complex Project

William F. Kearney, Jr. from Gilbane Building Company, who provided the construction management services on the Worcester Trial Court complex, will discuss the use of the CM at Risk approach. The $146 million, 427,000 square foot project was the first public project in Massachusetts delivered via a CM at Risk approach and will serve as a prototype for the states court modernization program.

This year’s annual construction law update will provide a “nuts and bolts” overview from the perspectives of the owner, contractor and subcontractor. Panelists will offer valuable insight into the issue of "The Contractor Files for Bankruptcy: What Happens Next?" They will examine what happens after the contractor files for bankruptcy protection, including, how the project is funded and completed and how the parties working on the project are paid. The panelists will address the impacts of a contractor bankruptcy from the perspectives of the owner, contractor, subcontractor and surety. The program will also include some bankruptcy basics, including a discussion of preference issues that every lawyer in this field should know.

GMP Agreements in Construction Law

Frank Vanzler and Jim Rogers of KVAssociates will discuss the term “reasonably inferable.” Often debated during conflicts between Owner, Contractor and Architect to resolve change order disputes, this term is universally used in GMP agreements and lump sum deals. Specifically, Mr. Vanzler and Mr. Rogers will address the following questions:
- What is the definition of “reasonably inferable?”
- Does the word "reasonably" help to clarify what is and is not inferable?
- Does a GMP deal assume that the Contractor owns more inferrability from the contract documents than a lump sum contract?
- Does this term get the Architect and Engineer "off the hook" from preparing a coordinated set of design documents?
- What would be better contract language to make the Contractor understand his obligation is to ownership of the contract term?
- Is it to the Owner's advantage to keep this term vague or have a more specific definition?

Dispute Resolution Models in Construction for Today and Tomorrow

Join us for a presentation by Lawrence F. Delmore. Mr. Delmore is the Executive Director of The Dispute Resolution Board Foundation, a non-profit worldwide organization of over 600 construction industry professionals. The organization promotes the avoidance and resolution of construction disputes through a DRB process, which is a pre-ADR claims avoidance project management tool that returns control of the dispute resolution model to the owner and the contractor.

Mr. Delmore is the former Lead Claims Analyst and DRB Manager on the Central Artery/Tunnel Project (the “Big Dig”) in Boston, MA and the former General Counsel of the Boston architect/engineer/contractor, Charles T. Main, Inc. He has spent overt 29 years in the construction industry assisting owners to avoid claims and resolve disputes in a timely and cost effective manner.
