Balancing Urban Waterfront Development with the Public Trust Doctrine Under Chapter 91

Join Rich McGuinness, Deputy Director for Waterfront Planning, Boston Redevelopment Authority, for his presentation focusing on the balance between urban waterfront development and meeting the requirements of the Public Trust Doctrine under Chapter 91. Special emphasis will be placed on the needs and demands of proposed ground floor uses versus the State’s requirements for such ground floor space. In addition, the speaker will lead a discussion on interpreting common terms and phrases used in planning documents, guidelines and regulations regarding urban waterfront planning.

Danielle Andrews Long, Robinson & Cole LLP, will focus on recent case law developments under Chapter 40B over the last 2 years. Special emphasis will be placed on the series of cases decided by the Supreme Judicial Court this past summer. These cases (and especially the Woburn case handed down by the SJC in June, which dealt with the important issue of de facto denials) have significant implications for a wide range issues in future 40B appeals.
