Please join the Real Estate Legislation Committee as it begins consideration of a new concept that would create in the General Laws a conveyancing foundation for owner-occupied housing whose use is restricted to persons and families of modest means. This includes a structure of statutory housing covenant, statutory housing conditions and statutory housing power of sale (analogous to those for mortgages).
A decade ago this market was the province of a few subsidy providers working through housing restrictions based entirely in contract, but today the expansion of 40B, CPA and related activities have resulted in many new participants. This raises the question whether it is time for the law to respond by offering the statutory underpinnings mortgagees have been offered for nearly 100 years.

This seminar will provide an overview of the important role bond financing plays in the development and financing of affordable housing projects. Panelists will explain how bonds work and the role of issuers, underwriters, rating agencies and other parties. Attendees will learn the differences between taxable and tax-exempt bonds and the issues that determine which type of bond financing is appropriate for a given project. As tax credits are a typical funding source in bond-financed projects, the seminar will also give an overview of the two types of tax credits available.
