1. BBA CLE: Advanced Topics in Construction Law and Litigation

Tuesday, June 17, 2008 - 3:00 pm - 6:00 pm
Boston Bar Association - 16 Beacon Street

This year's annual construction law update will examine various matters pertaining to construction law and litigation in Massachusetts.  Expert panelists will discuss the new AIA, Consensus and AOD Contract Documents, as well as examine the mechanics' lien law from a practical perspective.  The seminar will also include an update on recent reported cases on construction law, and a discussion on surety bonds.

2. Affordable Housing Deed Restrictions: Responsibilities, Liabilities, and Best Practices in Re-Sales, Refinancings and Foreclosures

MassHousing - One Beacon Street, Boston

Deborah Goddard, Massachusetts Department of Housing and Community Development (DHCD), will moderate a panel discussion on affordable housing deed riders. Panelists, including Leslie J. Cook, Chicago Title Insurance Company, will:

  • Provide a brief overview of the policy and statutory basis of affordability restrictions and key provisions,
  • Review the problems that regularly arise when property subject to a restriction is re-sold/ refinanced, or mortgage foreclosure remedies are exercised, and
  • Discuss "best practices” for title examiners and bank and foreclosure counsel.

Background:
Federal, state and municipal loan programs that support the development of affordable housing typically impose restrictions on property to maintain its availability to low-income persons or families for a specified period of time. A failure to comply with restriction requirements at the time of a re-sale, refinancing or foreclosure can raise significant issues, including potential challenges to the validity of a new mortgage, title insurance claims and liability for the unauthorized practice of law.

5. BBA CLE: Subprime Lending Crisis: Where are we going and why are we in this handbasket?

Boston Bar Association - 16 Beacon Street, Boston

Panelists will address the origins, current conditions and the future of the current foreclosure crisis. In addition, the presenters will review recently enacted mortgage lending controls and foreclosure prevention legislation and comment on lenders' responses to the foreclosure crisis.

Attendees will gain an understanding of predatory and subprime lending markets; what the subprime crisis means for lenders, owners, buyers, and sellers; and what government regulatory and enforcement actions have been taken to curtail the crisis.

For those who attended January's "Predatory Lending in the Trenches" CLE, which provided strategies to identify and pursue Truth in Lending and G.L.c. 93A claims, this is a great follow-up program!
