Joseph Callanan, Nelson, Kinder, Mosseau, & Saturley, P.C., will address the different interests that private land owners and members of the public have in coastal beaches, and attempts to clarify the language of coastal interests.
Owners of coastal land, also referred to as littoral land, want to know to what extent they own and control the beach and flats bounding their property. Neighbors, abutters, and members of the public want to know if they have access to the beach and flats owned by others, and to what extend control may be exerted over them by the littoral owners. Conflict over so-called beach rights arises commonly:
  • When abutters, neighbors, or members of the public assert "perpendicular" rights of access over littoral land owners to reach the beach and/or flats;
  • When new home construction obstructs access to, or view of, the beach and/or flats;
  • When access and ownership of littoral land is unclear; and possibly
  • When installation of improvements, wind turbines or solar panels obstructs views, access, and use of beaches and tidelands.



A part of the Real Estate Section, the Title & Conveyancing Committee holds monthly brown bag luncheon meetings featuring presentations and discussions led by committee members and guest speakers on such topics as mechanic's liens, survey matters and affirmative coverage, sophisticated title insurance endorsements, lis pendens, real estate litigation, title insurance claims, bankruptcy and creditors' rights, the land registration system, offers to purchase real estate, purchase and sale agreements, hazardous substances, forms of ownership, mortgages, foreclosures, easements and restrictions, and broker and lender relationships.
