Join Peter Shapland, Day Pitney LLC, to learn how estate plans often involve use of nominee trusts and other entities (particularly LLCs) to hold residential real estate. We will discuss income, gift tax issues that arise when drafting and implementing these arrangements, as well as the different governance issues that arise under the different entity choices. CLE Program

:The Massachusetts Principal and Income Act:  Clarification and Further Questions, Two Years Hence

On November 10, 2007, it will have been two years since then Acting Governor Kerry Healey followed the example of a number of other States and signed The Massachusetts Principal and Income Act into law.  The Act provided much needed clarification regarding how to account for principal and income in trusts and estates governed by Massachusetts law.  At the same time, a number of questions have arisen regarding how certain aspects of the law actually work.  Lawyers drafting and administering trusts under Massachusetts law have now had a little less than two years to get to know the Act.  This seminar, sponsored by the Trusts and Estates Section of the Boston Bar Association, is designed to take inventory of the Act.

Estate Planning for Artists

Join us as we discuss how best to plan for the unique issues that arise with artists’ estates. In their lifetimes artists can create hundreds if not thousands of pieces of art. This volume and its ultimate disbursement often create unique issues for artists, the lawyers that represent them, the executors of the estates and the artist’s heirs. Issues including storage, transportation, insurance, taxes and inventory can be complicated and costly while the art itself can be difficult to appraise. Moreover, the intellectual property rights outlive the artist, and therefore are a component of the artists’ estate that must be addressed.

Implications of New Hampshire ’s New Trust Laws for New England Estate Planners

New Hampshire adopted effective August 19, 2006, a comprehensive amendment to its Uniform Trust Code and related laws with the purpose of making New Hampshire the most attractive state for trusts and private trust companies in the nation.

Key changes include:

  • Limiting mandatory UTC provisions
  • Authorizing purpose and quiet trusts
  • Adopting a next generation principal and income act
  • Insulating trustees from liability for diversification decisions made in good faith
John P.C. Duncan, Principal, and Michael R. Conway, Jr., Counsel, both with Duncan Associates Attorneys and Counselors, P.C., were the primary authors of this legislation. They will review its implications for New England estate planners and discuss possible efforts to emulate the legislation in Massachusetts, Delaware and elsewhere.
