Scheduling Practices in the Probate and Family Court: A Bench/Bar Discussion

In response to concerns expressed by the legal community regarding the lack of uniformity in the manner in which cases are scheduled in the various courts within the Probate and Family Department, Chief Justice Paula Carey has appointed a Scheduling Task Force to review such matters and to provide her with recommendations for suggested changes. The Task Force, chaired by the Honorable Robert Langlois, First Justice of the Norfolk Probate and Family Court, is now conducting state wide forums to meet with practitioners in order to listen to their concerns and to hear their suggestions on how to improve scheduling procedures.

Judge Langlois, together with Task Force members Denise Squillante, former Chair of the Massachusetts Bar Association's Family Law Section, and Gayle Stone-Turesky will be conducting the meeting. The Task Force invites all of you to attend this forum and to discuss methods on improving scheduling procedures and protocol in the Probate and Family Court.

The Massachusetts Principal and Income Act: Clarification and Further Questions, Two Years Hence

On November 10, 2007, it will have been two years since then Acting Governor Kerry Healey followed the example of a number of other States and signed The Massachusetts Principal and Income Act into law. The Act provided much needed clarification regarding how to account for principal and income in trusts and estates governed by Massachusetts law. At the same time, a number of questions have arisen regarding how certain aspects of the law actually work. Lawyers drafting and administering trusts under Massachusetts law have now had a little less than two years to get to know the Act. This seminar, sponsored by the Trusts and Estates Section of the Boston Bar Association, is designed to take inventory of the Act.

Frank Sanclemente, Regional Counsel for the Financial Industry Regulatory Authority, will discuss the current initiatives of FINRA relating to the protection of senior investors. Mr. Sanclemente will discuss the regulatory issues affecting firms and registered representatives, as well as present an overview of enforcement matters originating out of FINRAs Boston District Office.

FINRA is the largest non-governmental regulator for all securities firms doing business in the United States and was created in July 2007 through the consolidation of NASD and the member regulation, enforcement and arbitration functions of the NYSE.

Massachusetts has implemented these changes, but done little to clear up their pervasive ambiguities. Fixing Broken Life Insurance Trusts

Full Program Description
This program is designed to help practitioners identify and address problems that can arise in drafting and administering irrevocable life insurance trusts, including tax issues.

The panel will address failures of Crummey notices or poorly drafted withdrawal provisions, inefficient allocations of GST exemption, and changed circumstances. Attendees will learn techniques for dealing with these problems including transfers to other trusts and judicial modification.

The Massachusetts Principal and Income Act will take effect on January 2, 2006, providing Trusts & Estates attorneys with comprehensive legislation governing principal and income allocations. It accomplishes two key objectives:
- a unified statutory scheme as to what constitutes income and what constitutes principal; and,
- giving power to trustees to adjust between principal and income in making distributions to beneficiaries.
